Parking fine ‘Cock-ups’.
It does appear that the Country is awash with some totally incompetent Councillors, Council officials and managers of Council departments, for such chaos and inconvenience to the public, with all this seemingly 'organised and deliberate confusion’ in order to assist 'boosting' Council funds - regardless!

I cannot but feel the whole system of 'Parking fines and the collection of payments there from, is based on the 'principle(?)' of issue tickets wherever and whenever possible (probably if there is doubt - or not!)

Some drivers may contest the 'Fine', although the odds are in favour of the Council that this will not happen, due to the complications and inconvenience, time consuming etc. and those who couldn't care less - the Company pays!

Almost a 100% winner all the way.

Due to these inconvenient 'blockages', no doubt well noticed by the Council officials responsible for running the Parking 'Piggy Bank', it is reasonable to assume that there will be more people who will simply pay up - regardless, than those putting up a ‘fight for right' - because of the expense and all the problems (dragging their feet - expertly, and difficult to overcome! ) that Council officials can put in their way, in order to defeat them - regardless of being right or wrong!

As we read about quite often, Councils dilatory and inefficient 'modus operandi' - in dealing with almost anything to do with financial 'pay back', is notorious, and in order to 'save face' (very important in the political field) they are usually prepared to fight to the death - an activity which can sometimes be very convenient and certainly has its merits and, of course, can be quite profitable ‘If cards are played right!’

The parking fine payment being paid, or not chaos, does seem more to do with a great deal of incompetence at council level, and where none should really exist! Or perhaps, as well as, an attitude of total 'bloody mindedness' to

We have legal opinion which we will be making available which will show that people who HAVE PAID non-compliant tickets are entitled to restitution.

They shouldn't refund a penny.

People broke rules set out legitimately under law, and were required to pay a penalty under law. Because of a very minor formal technicality, to do with the situation eleswhere in the UK, an adjudicator (not a judge) has upheld appeals.

Adults should recognise that there need to be consequences for breaking rules.

There is a story elsewhere in the paper about youth justice measures failing as some young people continue to commit offences with impunity, and citing the "rights culture" and the ECHR as part of the problem.

Why should young people who commit offences be required to attend "boot camps" and face lower tolerance for leniency by the Children's Panel administration, when adults are calling for people who break parking rules to be let off on a technicality?

The infringements might be different in nature but the principle isn't. Grown-ups acknowledge that when you break the rules you need to be prepared to face the consequences, even if you disagreee with the rules.

And the penalty doubles if you don't pay within 14 days.

The british government has taught us to fight for our rights now and that includes dodging parking fines. Just like the government is trying to hide their expenses from the public using a legal data protection act loophole.

Wouldn't it be good if we could just go back to what is right and what is wrong. The justice system in this country is a joke and the government has caused it.

They have taken away dicipline in schools and allowed terrorists to live in this country because of the human rights act that they have signed up to.

The legal fruternity love this because they are making a packet out of us by going to court for just about anything.

...and the council also broke the rules legitimately set out under law.

We therefore have an impasse. Neither side should have to bear a penalty. The parking fines should therefore be refunded.

You refer to a minor legal technicality. In Law these are extremely important and can usually be what Law is all about! No doubt the Council would, and probably does, take every opportunity when one shows its nasty little head - in their favour!

Whilst the ‘authorities’ cleverly hide behind some alleged attempt at ‘Public Good’ (probably for nothing more than their image) of trying to ease and control the problems of Car Parking, a great problem I know, but they are issued with precise legal rules and regulations - from upon high, which they must be well aware of.

If they decide not to bother to commit fully to them, themselves, and I cannot help but feel they do not have this option in Law, but by doing so, as it seems, that in itself seems to be illegal, proving much incompetence, and showing scant regard for the illegality of their actions.

And because they have ‘seen the light’ that by their actions it can be ‘a nice little earner’ with little, or no possibility, of their ‘own bloated authority’ ever being successfully challenged, because of all the stumbling block they can, do and probably will adopt, they carry on regardless!

This illegal activity, or incorrect activity by Councils, in the great Parking Battle with the motorist, by not carrying out correctly the instructions issued, and now the only legal ones to be applied - regardless, do not come across as small ‘one-off human slip ups’, as, from programmes seen on TV over quite some length of time now, it appears to be widespread across the Country, which must speak volumes for the ‘Care in the Community’ Councils and their competence - or lack of same!

I had an appeal running on another issue relating to 3 parking tickets and a towing charge when my vehicle was thought to have been stolen and the Council abandoned the case and refunded all my money months ago based on the Barnet case.

I am certain that if anyone who has paid in the relevant period claims their money, back the Couincil will have no choice other than to repay. Of course, they should do the decent thing and repay all 700, whatever it takes; but their arrogance is breathtaking.

Well I hope I am one of them. I have a few and none of them were legitimate fines. Some were given while I had a ticket displayed but the warden told me they werent displayed 'correctly' or one of my wheels extended the bay line by an inch or even though I still had two minutes left on the clock etc etc etc

Pray tell, what does "thole your doom" mean?

Where I live we have a new $3,000 (Cdn) digital surveillance system that can download images on the building manager's computer.

The Ottawa Police Services will not even consider pursuing a trespass or vandalism or other "criminal" activity without a TIME AND DATE.

In order for my Board of Directors to pursue further action we must have the bare minimum of time and date. The image(s) captured digitally can be downloaded onto the office computer and printed in hardcopy for evidential purposes.

Has not this always been a minimum standard to pursue illegal activities - time, date, image?

What annoys me are those who jump with glee when motoring law breakers get away with their crime on some feeble technicality.

These will undoubtedly be motorists
themselves and will be the very same people who criticise the law when yobos who have committed an act of vandalism get away with it also on some legal technicality. They also will make the point that letting the vandals off will generate far more serious criminals later on.
These petrolheads with their pumpkin mentality just cannot make the link and should go back to playing with their dinky toys to make the roads safer for the rest of us who treat driving as a serious matter and not a game.
