There is no need for evidence in an undefended case.

However the concept of an 'impartial tribunal' could be questioned, as could abuse of process, or the question of jurisdiction.

Its quite hypocritical that the US should sue Iran for killing its troops, when the US furnished Saddam with weapons to use against Iran, and as mentioned above shot down an Iranian airliner with 290 civilians on board including 66 children.

If the US wishes to try to police the rest of the world, I guess it was just the next step to attempt to become the civil court for the world too.
