Devine faces Labour 'star chamber' and election ban

A SCOTS Labour MP was today facing the prospect of being barred from standing at the next General Election amid allegations that he misused his parliamentary expenses.
Jim Devine, the MP for Livingston, has struggled to justify claiming £4,483 of public money, apparently for 66 metres of office shelving for his constituency office and electrical repair work at his London flat.

He will face a "star chamber" of Labour officials that has already prevented four MPs from representing the party after a public outcry over their claims.

Mr Devine is expected before the three-person panel this morning in London, though a Labour spokesman said there was a chance this may not happen until tomorrow.

He could not be reached yesterday, but Livingston Constituency Labour Party chairman Tony Boyle said: "I hope for Jim to be still our candidate at the end of the time. We await the outcome."

Mr Devine is said to have claimed £2,326 for joinery and "heavy duty" shelving, and submitted an invoice for the amount to the Commons authorities in the name of Tony Moran, a landlord in his home town of Blackburn, West Lothian.

He also charged £2,157 for electrical work in his London flat, which he claimed was carried out by Mr Moran.

Mr Devine, who vowed to call in the police in an attempt to clear his name, said he would provide the Labour National Executive Committee endorsements panel with photographic evidence of the work. He has suggested he is the victim of a vindictive campaign by a former employee.

Last week, Mr Devine appeared in front of his constituency party to answer questions on the affair, and appeared to win their backing.

He told his local paper that he was confident of being cleared. "I look forward to standing in front of the NEC panel and putting my side of things across," he said. "I just want this boil lanced now."

It comes as Sir Christopher Kelly, the watchdog charged with delivering lasting reform of the MPs' expenses system, admitted he had been "surprised and shocked" to learn of the multitude of questionable claims made by MPs as the scandal unfolded.

Sir Christopher's Committee on Standards in Public Life will tomorrow begin public hearings in its search for greater transparency and better value for money.

It will take evidence from Harriet Harman, Labour's Leader of the House of Commons, and her Tory and Liberal Democrat opposite numbers, Alan Duncan and David Heath.

Sir Christopher announced yesterday that he hoped the committee would complete its work by the time parliament returns in October, after the summer recess.

"How we see our role is basically to clean up the expenses system," he said. However, it would be a "long and difficult process" to restore public trust in parliament, he added.

Despite the Prime Minister's call for a ban on MPs taking second jobs, Sir Christopher said he was mindful that this could deprive the Commons of "experience and diversity" and create a class of professional politicians.

Ms Harman said that MPs with second jobs would, from 1 July, be required to reveal how much they earned, who they were paid by and how much time they spent away from parliament. She hopes new laws will be in place before MPs begin their summer holidays on 21 July establishing a Parliamentary Standards Authority – an external body checking and paying all MPs' expenses.

On Thursday, former communities secretary Hazel Blears will be the first Labour MP to face a motion of no confidence when she goes before her Salford constituency party. Union chief Paul Kenny expects 50 Labour MPs to quit as a result of pressure following their expenses claims.


'A mischievous, larger than life character'

JIM Devine, 56, is known throughout Westminster as a mischievous, larger than life character, as fond of sharing gossip over a pint as popping up to make a point from the green Commons benches.

A former psychiatric nurse who became a health union official with Unison, he was constituency agent to former foreign secretary Robin Cook for 22 years, and inherited his boss's Livingston seat in a 2005 by-election after Mr Cook's sudden death.

Mr Devine is a founder member of the Celtic Supporters' Trust and a keen horseracing fan. But he has shied away from talking about his expenses – and may not be allowed to defend a slim 2,680 majority.

Devine attempted to explain the mystery by telling his local newspaper the shelves were at his London home. However, Moran flatly contradicted that when he spoke to the Sunday Herald. At an emergency Labour Party meeting in Livingston last week, the MP then said the shelves were installed in the cellar of a former Blackburn pub.

The public house, now closed, was run by Moran when the expenses claim was made in March 2006. Devine is said to have told local party members he was reluctant to discuss the joinery claim as the shelves were used for storing party political material. House of Commons rules forbid MPs from using the publicly-funded expenses system for party purposes.

In a BBC interview last week, Devine tried to explain the joinery riddle. Asked where the shelves were, he said: "Just down the road in a shed. They're industrial shelves. They were used to store office equipment, my personal equipment, and ... other party material."

Asked why he could not give an inspection of the shelving, he said: "Because they're in, they're in, a what-d'you-call-it, they're in a cellar that, sadly, the pub has gone bust. And that's where the material had been stored."

Asked if he had rented the pub cellar, Devine said: "Rented this space out and, what-d'you-call-it, used the shelves, the industrial bought shelves, so we could store this material."

He said the pub was called The Crown, but a visit to the former Crown Inn by the Sunday Herald reveals further discrepancies in Devine's story.

The space Devine said he "rented" to store office equipment, personal files and Labour Party material is a filthy shed, half-filled with beer kegs, pipes, and dusty bric-a-brac, with broken glass strewn on the floor.

Although there was shelving inside, it did not match the description on Moran's invoice.

Instead of 66 identical "lineal metres", there was less than half this amount in the cellar. It was also in three different types, three different sizes, and three different colours. Not one shelf was a metre long.

Two also carried faded labels saying "Mar 00" and "April 00". Devine was elected an MP in September 2005.

Franco Cortellessa, the new owner, said many of the shelves were already rusted when he bought the Crown in October 2007, less than 18 months after the date on Moran's invoice.

Cortellessa, who plans to re-open the Crown in October, said when he took over the pub the shelves had been full of bar supplies and clothing, but no Labour Party material.

"It was all Tony Moran's. There was nothing to do with a party or anything like that,'' he said.

A former employee at the pub said the cellar was completely unsuitable for storing office equipment or supplies.

"It was where all the bottles and barrels were kept. Never in its puff has it been used for that a Labour Party base. The only time I've seen Jim Devine has been when he's been going to the shops."

Both made by the same person. Either he has dementia or selective amnesia.

There are a lot of words I would use to describe Devine and none of them would be honourable.

Clearly Tony has been on retreat for the past 3 months and has yet to read the facts of the matter.

Having said that, pub cellars and political party constituency offices are notoriously similar. It could well be a genuine mistake.....couldn't it???

So first off he could not remember the name of the electrician, though the company who did the work was eastern electrical ltd, then he did not know where the electrician was, he might be up north somewhere or dead anfd then hey presto, its the arthritic publandlord who put the shevles up in the constituency office, or was it the pub cellar or a shed or in the london flat ?
And just could not find an electrician in the whole of London to do some electrical work ? so he got one , that if he is actually an electrician at all, to come all the way from Scotland to the work.Jack of all trades master of none ?

Mr Devine is in the labour party therefore the BBC will say he is completely innocent.

It would be a lot easier to raise the electrician from the dead than to raise Devine's lackluster uninspiring career from the dead I reckon.

He has talked a load of utter guff throughout this, and it will be an enormous mistake for the Labour investigation to clear him this afternoon as there are way too many dodgy answers and statements from Devine throughout this under reported debacle.

The Scottish newspapers have deliberately avoided a great story, one with utter relevance to what is happening in westminster.

If the Met are looking into things perhaps someone should talk Mr Devine into protesting his innocence outside Westminster, he'd probably get the kicking he so richly deserves, and he seems stupid enough to do it.

Lanour lies - it isn't just Adam Ingram who is profitting from the war game - John Reid is too. Both of these murderous b@stads are way ahead of anyone involved in mere expenses, but no one seems to be reporting on them.

That’s a fair point, I’ve got 200ft of shelving in my office, erm in my house, I mean my cellar or is it my shed? whatever.

The point is I met this bloke in the pub who did the work for me and he might be dead or he might be somewhere up North but that’s not really the point either.

The main point is I’ve got an invoice for the work and the Company’s address is Southark Bridge Road and even though there's no such road it doesn’t mean that it doesn’t exist cos it does exist cos I’m a fine and honourable Labour MP beyond reproach and anything I did wrong wasn’t my fault cos it’s the system to blame but if it helps I’ll pay the money back and go on TV waving a cheque and if Darling can get away with it then surely I should …… Blah, blah, blah…

As Shaun Ryder once said, call the cops.

This Labour star chamber should be reporting these MP's that they are deselecting due to dodgy expenses to the police for fraud, and that includes Devine if that becomes the case, otherwise they will be just as guilty for not reporting the crime that led them to their decision.

Funny there is a photo that was doing the rounds of the journalists that caused a certain Paisley MP to commit suicide at the time as it involved rent boys and is said to include Jim Devine. Seems he is fond of sharing a lot of things.

I've viewed the photograph of the offending shelves in the pub basement Mr Vivas and I think in fairness to Mr Devine we can easily imagine it being a constituency office once someone takes a feather duster over the shelves....and of course the ..eh...beer kegs...and eh... the cardboard boxes....not to mention the large bags of cement.

On the other hand I've taken the precaution of sending Mr Devine a map to the local job centre.
