IN A decision that could have serious financial consequences for trade unions, the Court of Appeal ruled the GMB indirectly discriminated against some of its female members when it recommended they accept a deal over back pay that was less than their claims were worth.
The Allen case is part of the long-running single status equal pay dispute, in which Middlesbrough Council was trying to implement an equal pay deal that involved compensation for back pay and agreement for equal pay rates in the future.

The significance of the Allen case is that - for the first time - the trade unions have been told that they must be seen to balance competing interests of different groups of members - instead of simply riding roughshod over them as they have done in the past - on issues like equal pay.

That will be a big challenge because trade unions are not used to acting openly and transparently - despite the changes that have taken place in Scotland they are still highly politicised on a partisan party basis - and often fail to properly reflect the views of their own members.

The Allen case has struck a blow for ordinary unions members - fed up with the politicking and posturing - and that can only be a good thing in the long run.
